This privacy policy ("Privacy Policy") describes how ITER IMPIANTI TECNICI SRLS , a company with its registered office at Via Giuseppe RivanI, 59/D BOLOGNA (BO), identification number: 04132611205 collects,

stores and otherwise processes personal data in connection with the use of the Safe Driving application and service ("Application") , the purpose of which is the temporary blocking of other applications, phone calls , notifications and to put the phone in do not disturb mode when exceeding 10 km per hour while driving or if in the event that the Gps is disabled, there is an above average linear acceleration - by Users (" Service ").

This Privacy Policy incorporates and is incorporated by reference into the Terms of Use of the Safe Driving Service ("Terms"). Capitalized definitions/terms specified in the Terms have the same meaning herein.

The protection of privacy and processing of personal data is a priority for the Operator and the processing of personal data is considered strictly confidential. Personal data will be processed in accordance with applicable and effective data protection laws and regulations, including the EU General Data Protection Regulation 2016/679 ("Regulation").

The Operator may change this Privacy Policy at any time with immediate effect. We will notify you of such changes. 

The latest version of this document is available in the footer of the Web Interface and via a link in the relevant section of the Application.

If you choose to use our Service, you agree to the collection and use of information in connection with this policy.

General ​information Collection and Use:  Pursuant to the Regulations, the Operator is the controller of your personal data, i.e. the Operator collects, stores and uses (and otherwise processes) your personal data in connection with its business activities (the individual purposes for which personal data is processed are specified below ).

Without your consent, we may only process personal data that is necessary for the performance of the contract (i.e., the provision of the Service) and other contracts we may enter into with you or for the purpose

of fulfilling our legal obligations and/or for legitimate interest purposes. In other situations, we process your personal data only if you give us your consent to process your personal data.

We process personal data both manually and by automated means. We process personal data by automated means for the purpose of the performance of a contract (the provision of the Service), in particular, to ensure the internal procedures of the Operator and its contractual partners necessary for the provision of the Service.

This Privacy Policy describes the purposes of the processing of personal data and the manner of processing, provides information regarding the individual categories of personal data to be processed,

the individual recipients of personal data, the period of storage of personal data, and your rights regarding the protection of personal data .

Collection and use of information

ITER IMPIANTI TECNICI SRLS does not collect or store any personal information, with the exception of data needed to monitor initial access to the Safe Driving app and possibly manage in-app purchases at a later time.

This data is voluntary and the other services can be used without creating an account. 

 

Purposes of personal data processing Your personal data may be processed by the Manager for the following purposes:

Performance of a contract with the User (fulfillment of the mutual contractual relationship under which the Service is provided to the User); Fulfillment of legal obligations ; Protection of the legitimate interest of the data controller (protection of the Operator's legally protected rights and interests, e.g. creation of statistics on the behavior of Users of the Service); Distributing commercial communications and offer of services and goods (the Operator may send you commercial communications related to the Service via e-mail or push notifications); Handle requests from Users (e.g. using the ability to contact the Operator via the Application).

Types of personal data processed    Categories of personal data In connection with your activity and based on the content of the activity, the following personal data may be processed in the course of providing the Service:

  • Phone number: Used to track first access to the app. We use it as a unique parameter.

Basically we use these permissions and data only for the functionality of the app.

Security and confidentiality of personal data

Personal data are stored on secure servers in special computer systems. The Operator has taken appropriate technical and organizational measures to prevent any loss or destruction of personal data,

any access to the data by unauthorized persons, and any modification or disclosure of the data.

 Access to the inventory of installed apps The Service requires access to the user's installed app inventory to provide its basic functionality, such as blocking configuration and usage statistics. This data is used solely for the purpose of providing the user with the required functionality, according to the user's configuration. No app inventory data is stored or otherwise used.

 Access to location data The Service offers optional functionality that requires the use of device location data, including the precise GPS location of the device collected through its location services as well as geofencing, as provided by the Android Geofencing API. This location data is used solely for the purpose of providing the user with the required functionality as configured by the user. No location data is stored or otherwise used.

 Access to location data in the background

The application requires access to device location data even when it is not actively being used in order to provide certain functionality. This access is necessary to ensure the proper functioning of services such as geofencing and other functions that require knowledge of the device's location even when the application is not in the foreground.

We reassure users that location data collected in the background is used only to provide the required functionality and is not stored or used for any other purpose. The privacy and security of user data is paramount to us,

and we are committed to ensuring that location data is used only in a manner that complies with applicable data protection laws and our internal policies.

Rights of data subjects In relation to the processing of personal data, you have the rights specified below, under the conditions of Articles 15 to 21 of the Regulations, which you may exercise at any time:

They include the right: (i) to access your personal data, (ii) to rectify inaccurate or erroneous personal data and to supplement incomplete personal data, (iii) to erase personal data if they are no longer necessary

for the purpose for which they were collected or otherwise processed or if it becomes apparent that they have been processed unlawfully, (iv) restriction of the processing of your personal data, (v) data portability, and (vi)

the right to object following which the processing of your personal data will be stopped, unless it is demonstrated that there are serious legitimate grounds for such processing that override your interests or your rights and freedoms, particularly if the ground is a possible assertion of legal rights.

 

Right to access your personal data: if you are interested in knowing whether the Operator processes your personal data,

you have the right to obtain information whether any processing of your personal data is taking place and, if so, you have the right to access your personal data;

Right to rectification of inaccurate personal data and completion of incomplete personal data: if you believe that the Operator is processing your personal data that is inaccurate or incomplete,

you have the right to request rectification and completion. The Operator will correct or complete such data without undue delay, taking into account technical possibilities.

Right to erasure: If you request erasure, the Operator will erase your personal data, provided that: (i) it is no longer necessary in relation to the purpose for which it was collected or otherwise processed;

(ii) the processing is unlawful; (iii) you object to the processing and there are no overriding legitimate grounds for processing your personal data; or (iv) the Operator has a legal obligation to delete your data.

The Operator will not act on your request if any of the circumstances set forth in Article 17(3) of the Regulations prevent this;

 

Right to restrict the processing of your personal data: if you request restriction of the processing of your personal data, the Operator will make your personal data inaccessible,

temporarily delete or store or otherwise process your data as necessary for the exercise of this right;

Right to data portability: if you want the Operator to transmit your personal data processed by the Operator based on your consent or data necessary for the performance of a contract to a third party, you may exercise your right to data portability. If the rights and freedoms of third parties are affected by the exercise of your right, the Operator will not be able to process your request;

Right to object: you have the right to object to your personal data being processed for the purpose of acting in the public interest or in the exercise of public authority or for the purpose of protecting

the legitimate interests of the Operator. If the Operator fails to demonstrate that there is a serious legitimate reason for the processing that overrides the interests or rights or freedoms of the customer,

the Operator will stop the processing without undue delay.

 

In the event of repeated or manifestly unfounded requests for the exercise of the above rights, the Manager shall have the right to charge an appropriate fee for their implementation or to refuse to do so.
